Judge Dismisses One Of 11 Counts Against Harvey Weinstein

A Los Angeles judge has dropped one of the 11 charges against Harvey Weinstein, allowing prosecutors to still be able to amend it.

Weinstein's attorneys have filed motions to dismiss three of the 11 charges against him, on the premise that the statute of limitations had expired.

Los Angeles Superior Court Judge Lisa Lench has refused the dismissal of two of the counts but has requested prosecutors return to court for the amendment of the third count.

Last week, Weinstein pleaded not guilty to the 11 counts of sexual assault against him. 

The occurred one day after his relocation from New York to Los Angeles.

He has been in New York serving a 23-year sentence after being found guilty last year of first-degree criminal sexual act, and third-degree rape.

Weinstein entered court pushed in a Los Angeles County jail wheelchair. He was wearing a blue medical mask and a prison jumpsuit.

Weinstein's legal team claimed victory after the hearing.

Mark Werksman, Weinstein's defense lawyer said, "Stick a fork in count five, it's done."

He was referring to count five of the indictment, a sexual battery by restraint charge that prosecutors claim Weinstein committed in May 2010.

Prosecutors are prepared to amend count five.

Weinstein's defense team requested the ban of photos and videos of Weinstein in a "rumpled" jail suit, on the claim it made him look guilty.

Judge Lench denied this request.

Weinstein's new court date is September 13th.
