Harvey Weinstein About To Be Tried On Beverly Hills Rape Charges

 

By now the whole world knows about Harvey Weinstein and all that he's done.

Many might not know that prosecutors are now ready to try him on the Beverly Hills rape charges.

The Los Angeles County District Attorney's Office has recently filed papers that state "the Los Angeles County Sherriff's Department is capable of providing medical care" to Harvey Weinstein, on account of his attorney's filing papers wanting to block transferring him from a New York prison until he is "medically fit."

Court papers filed on Tuesday, June 6th 2021 state that the prosecution is "ready to bring petitioner to trial" but they are aware of his 'statutory right to be brought to trial within 120 days of arriving in Los Angeles.' This is where the accused is facing sexual charges.

"The People are informed and believe that Los Angeles County Sherriff Department [respondent] is capable of providing continuity of medical care to petitioner while in respondent's custody..."

There is yet to be a court date scheduled in Los Angeles for the defendant's petition.

June 15th, 2021 saw a judge in New York rule Weinstein "could be moved from a prison in that state." Weinstein is serving 23 years after conviction of a criminal sex act, performed against a former production assistant, as well as raping an aspiring actress.

A statement released that day saw one of Harvey Weinstein's attorney's say, "We are disappointed by the judge's ruling, but we are appealing his decision and have filed a habeas corpus petition in the Los Angeles Superior Court to prevent the Los Angeles County District Attorney from transporting Mr. Weinstein to Los Angeles until he can receive the medical care he desperately needs in New York."

The Los Angeles court filing states Weinstein "is in urgent need of medical treatment to save his eyesight, and that this treatment could take anywhere from 24 to 36 months." It also asks a judge in Los Angeles to delay possible transfers until all medical treatments have been completed.

The judge in New York was told by an Erie County prosecutor that attempts to bring Weinstein were "probably more likely in the first half of July."

Norman Effman, another one of Weinstein's attorney's, said authorities in Los Angeles "could do a virtual arraignment to allow Weinstein to get the needed medical treatment and be present in Los Angeles for the start of the jury selection for his trial."

The judge residing denied the request for a 10-day stay.

The defence proclaims in the court papers filed in Los Angeles that "the Los Angeles District Attorney's Office is seeking to transport and hold petitioner in unacceptable conditions because transporting him here necessarily means delaying or denying the specialised medical treatment he requires, which could result in irreparable harm to petitioner's eyesight."

"As such, this court should order the Los Angeles District Attorney's Office to release petitioner and allow him to remain in the physical custody of New York State until such a time as he is medically fit to proceed to be transported and stand trial."

Weinstein is evidently facing a sealed indictment in Los Angeles, containing the same 11 counts he was initially charged for. This indictment could allow prosecutors to move to trial a lot quicker.

Weinstein was first charged in January 2020 with sex-related charges which involved three women. Last October, there were additional charges placed against him alleging he sexually assaulted more women in Beverly Hills.
